Whereas James and Vickie Rauh owns and stands the Jack ( which may also be refered to ask stallion or stud ) “ Diamondback Cowboy“ , registered with the American Council of Spotted Asses Reg # SA 2196 and the Purchaser owns the said mare. Purchaser hereby agrees to read all stipulations contained in this Contract as may be applicable to them and/or their mare/s, and to submit all necessary information requested herein: STALLION SERVICE FEES: The 2007 breeding season for Diamondback Cowboy, offers a stud fee of $150.00 . A non-refundable Booking fee $50.00 is payable when this contract is signed and returned. This fee is applied to the total breeding fee of $150.00 . The balance of which is due prior to live cover of the mare. Payment: Mare Owner hereby agrees to pay said breeding charge of $___150.00___ plus mare care. Mare care is due at end of mares stay. Date Mare in: ________________ Paid $ ___________________ Date Mare out: ________________ Paid $ ___________________ RETURN BREEDING PRIVILEGES : Stallion Service Fees are non-refundable: In the event that Mare Owner’s mare does not take and become in foal, or miscarries, James and Vickie Rauh, must be notified in writing by a veterinarian . Stallion Owner agrees to breed that mare again before 15 months of the last breeding date of said mare, provided the mares owner has returned said mare for breeding services. Substitutions of said mare for another only upon approval of Stallion Owner. If said mare fails to concieve or fail to carry a foal after two breedings , Stallion Owner shall have no further liability for servicing said mare. If for any reason that Diamondback Cowboy becomes unfit for breeding service, be sold, or die, Mare Owners have an option to breed their mare to any other Jack owned by James or Vickie Rauh , Diamondback Mules. Mare Care charges will be charged for all re-breeds. HANDLING of MARES and FOALS on PREMISES: Mare Owner is advised that Diamondback Mules, James and Vickie Rauh, will not accept mares for breeding on premises that are not halter-broken and cannot be tied or placed in Breeding Stocks or hobbles. Mare Owner authorizes Diamondback Mules, James or Vickie Rauh to have a veterinarian to use palpation and/or ultrasound examinations as well as any emergency treatment due to illness or injury of the mare and/or her foal. (cost of procedures requiring the services of a Veterinarian will be billed by the Veterinarian directly to the Mare Owner.) Staff also requests that foals be halter-broke before arrival so they may be kept under control during all required breeding diagnostics or live cover breeding of their dams. Owner must remove any horse shoes from back feet of mares. ON SITE MARE/FOAL CARE & LIABILITY RELEASE: Board for on site dry mares is $5.00 per day. A mare with foal’s board will be $8.00 per day. Mare care will be charged. No negotiations on whether the mare is stalled or pastured. Mare care will start accruing in full on the day of arrival, and continue through the day of departure. Mare Owner agrees to assume the risk of loss due to injury, sickness, or death of said mare and /or foals for any reason. All due diligence and personal observation are exercised in taking quality care of on-premise mares and/or foals. Mare Owner stipulates and agrees, however, to hold James and Vickie Rauh, Diamondback Mules and its agents and employees harmless from any and all damages, injuries and/or loss associated with the mare/s and/or foals. Purchaser authorizes Staff to take immediate appropriate action in treating and caring for any animals in their care should Purchaser be unavailable for urgent consultation at the time a dire emergency might arise. Clients are urged to advise James and Vickie Rauh, Diamondback Mules, of their exact location and telephone numbers should they plan to be away from a permanent residence or normal place of business for an extended period of time while their animals are left in the custodial care of Diamondback Mules. If applicable, Purchaser agrees to notify. Diamondback Mules name and emergency telephone number of any new Insurance Company to whom their equine policy may have been transferred after the execution of this Breeding Contract. To protect against said loss or injury, Stallion Owner strongly suggests that Mare Owner at their own expense, secure liability insurance for personal injury and/or property damage and to provide a certificate of insurance having Stallion Owner named as additional Insured. NEGATIVE COGGINS, VACCINE PROGRAMS, WORKING, BREEDING SOUNDNESS, ILLNESS, ETC.: No mare/s can be accepted on premises who have not received a Negative Coggins Report within THREE months prior to date of their arrival. All vaccinations, including West Nile Virus should be current. Mare Owner warrants that said mare is free from disease or infection that could be transmitted to said stallion, and agrees to pay for and provide, upon arrival, a clean culture showing freedom from disease or infection dated within 30 days of mares arrival.. Any animals delivered to Diamondback Mules, James and Vickie Rauh, who exhibit illness, nasal discharge, etc., will not be accepted upon arrival. The goal is to have client horses arrive healthy and remain healthy while on Diamondback Mules, James and Vickie Rauh premises, as well as our own. Due to the diet sensitivities of some horse, it is suggested that Mare Owners bring a 3-day supply of their animal’s usual diet in order to make any transition in feed or feeding schedules less stressful. If the mare/s and/or foal/s are known to have any allergies to drugs, topical sprays, etc., please advise Diamondback Mules. Stud Owners must be made aware of any special feeding instructions before mares arrival and all special feeds / medications to be supplied by mare owner. The parties hereto acknowledge and agree that the full Service Fee of $150.00. This fee is due in full prior to live cover of the mare. ENTIRE AGREEMENT: This Contract constitutes the entire agreement between the parties hereto and may not be modified except in writing and signed by all participating parties. This Contract shall not be assigned, sold or transferred by any parties hereto without the consent of the others. If the original designated mare is to be replaced by a substitute mare without the prior approval of said mare by James and Vickie Rauh , then the Mare Owner whose signature is on this Contract becomes liable for such actions, and the Contract will be canceled at the discretion of the stallion owner, James and Vickie Rauh , Diamondback Mules, will be canceled at the discretion of the stallion owner, James and Vickie Rauh , Diamondback Mules.
